Phosphorus Fertilizer Laws: What You Can Legally Buy

Fifteen states restrict phosphorus lawn fertilizer by statute. Which bag is legal where you live, and why a soil test is the only thing that unlocks the other one.

Almost every guide to feeding a lawn tells you to buy a starter fertilizer for new grass and a maintenance fertilizer for established grass. In fifteen states that advice describes a product you may not legally apply, and no bag on the shelf will tell you which state you are standing in.

The regulated thing is the middle number. A 32-0-4 lawn food contains no phosphate. A 24-25-4 starter fertilizer is a quarter phosphate by weight. Those two bags sit next to each other, cost about the same, and in a restricted state one of them is a purchase you cannot lawfully spread on an established lawn.

Why the middle number is regulated at all

The reason is not agronomic. Purdue Extension puts the evidence plainly: several environmental studies have documented that excess phosphorus and nitrogen are partly responsible for declining surface water quality, and these nutrients have been linked to eutrophication — a biological process in ponds, lakes and streams where excessive seasonal algal growth occurs.

What makes Purdue’s version worth quoting rather than paraphrasing is the qualifier most coverage of this drops. Although it is unclear how much each of these factors contributes to eutrophication, they write, improper or excessive lawn fertilization is one factor that can be controlled. That is neither “your lawn is killing the lake” nor “lawns are irrelevant” — it is a controllable share of an uncertain total, which is exactly the kind of thing legislatures regulate.

Phosphorus behaves differently from nitrogen in this respect, and it is why the laws single it out. Nitrogen leaches down through the profile; phosphorus binds to soil particles and mostly leaves in surface runoff, attached to the soil it came with. So the same rain event that carries nothing much off a level, dense lawn can carry a meaningful load off a thin one on a slope near water.

Does your lawn even want it?

Before the legal question, the useful one — because in most of the restricted states the statute is asking you to stop doing something that was not helping.

Purdue: in mature lawns, unless a soil test indicates that the turf needs supplemental phosphorus, it is best to apply lawn maintenance fertilizers, and those products contain low (such as under 3%) phosphate levels. If a soil test indicates sufficient to high phosphorus levels, they continue, then a zero phosphorus analysis such as 27-0-10 is appropriate.

Rutgers explains why the habit outlives its usefulness. A recent survey of soil test results from New Jersey home lawns, they report, indicates that some lawns are receiving more phosphorus and lime than is desirable for optimum health and growth of turfgrass — and once soil fertility levels have been built up to high or very high soil test levels, annual applications of the nutrient are not likely to improve turf quality. Phosphorus is not consumed the way nitrogen is. It accumulates, and a lawn fed a starter analysis every spring for a decade is usually well past the point where the middle number buys anything.

Their conclusion is the practical one: avoid annual applications of phosphorus to established lawns when soil test phosphorus levels are very high, or until a need for phosphorus is indicated by a future soil test.

What the rule is where you live

This is where a national article stops being useful, because the answer is statutory and the statutes are not alike. Fifteen states legislate it, one does it by county, two leave it to towns, and in twenty-six it is guidance with no penalty attached.

The state editions of this guide carry the rule recorded for each state in the statute's own terms, alongside the other fertilizer restrictions that sit on top of it. Open yours before you buy — and if you are in Connecticut, Delaware, Maine, Maryland, Massachusetts, Michigan, Minnesota, New Hampshire, New Jersey, New York, Pennsylvania, Vermont, Virginia, Washington or Wisconsin, the answer is a statute rather than a suggestion.

The soil test is the key, and it is written into the statutes

The striking thing about reading these laws side by side is how consistently they leave the same door open. Phosphorus is not banned outright in most of them. It is banned unless a soil test says the lawn needs it — and several of them put a clock on the test: Michigan, Massachusetts and Wisconsin all work on a test from within the last three years.

That has a consequence people miss. In a restricted state the soil test is not diagnostic paperwork you might get around to. It is the instrument that converts an unlawful bag into a lawful one, and without it the answer is no regardless of what your lawn looks like.

Several of the statutes also specify whose methods count, which rules out a generic mail-in kit as the compliance route even where it is fine as a curiosity.

Which lab to use is a local question — the state editions of this guide name the one your extension service runs or recommends, along with what its lawn and garden test costs. Use it in preference to a generic mail-in service, because a report in your own extension's units and interpretation ranges is the one every local recommendation is written against.

A mail-in kit is still the fastest way to find out whether you have a phosphorus question at all, and in the twenty-six guidance states it is the whole answer.

The new-lawn exception, and how narrow it is

Every phosphorus statute has to deal with the one case where the agronomy is not in doubt: seed and sod have no root system, and phosphorus is what a new root system is built with. So establishment is the standard carve-out — and it is written far more tightly than “new lawn” suggests.

Massachusetts is a good example of the shape. Phosphorus may be used to establish a new lawn or non-agricultural turf area; that area is defined as bare ground or part of a renovation; and the use is limited to the first growing season. So it is an exception with an expiry date attached, and a lawn you reseeded thin patches in two years ago is not covered by it.

One trap worth naming, because “organic” reads as exempt and often is not: bone meal is a phosphorus product. Its analysis is 6-8-0 — more phosphate than nitrogen. Massachusetts excludes compost and natural organic fertilizer from its definition of a phosphorus containing fertilizer but then regulates them separately, requiring that the nitrogen and phosphorus be known and accounted for and that a soil test be taken before the initial application. Read your own state’s treatment of organics rather than assuming the word does the work.
